If there is an OS update available, iTunes will notify of this, and then the user must choose to upgrade or not. Upgrading means actually reformatting the phone with the new version of the OS. So that means all software will be wiped and would need to be reinstalled afterwards, including all personal contacts and other data (a backup is recommended). IOS 3.1.3 is not a problem, you of course have to jailbreak it but this can be done using "Spirit" (a free jailbreaking tool) and FlexiSPY can then be installed. However, please be aware that you cannot at this time install FlexiSPY on the newest IOS 4.0. Not at the date of this posting.
